Witnesses of fact – on behalf of the claimant
Following his dismissal, a senior manager took employment in a rival company. It was soon realised that, besides poaching staff, he and others had appropriated and were using both technical and commercial information from the company they had left in order to build their new business.
Mr Brear and Mr Williamson were required to assist the claimant’s lawyers in identifying the intellectual property and commercial information involved and to prepare statements as witnesses of fact. On the steps of the Court, the defendant was obliged to make certain admissions and offer a settlement sufficiently large that he had to issue a profits warning.
